 This Shipping and Delivery Policy (“Shipping Policy”) is applicable to the customers of ‘vitalvittles.in’ a brand of Cosmo First Limited (Formerly Cosmo Films Limited), who for the purpose of buying the products and for subscription of services have visited website vitalvittles.in (“Website” or “Platform”).

This Shipping Policy is meant to assist and educate the customers about the process of shipping and delivery of products ordered by the customer through Platform and about the shipping charges that will be paid by the customer.

For this Shipping Policy, wherever the context so requires “you” or “user” or “customer” shall mean any natural or legal person who has agreed to become a buyer / customer by registering himself / herself on the Website by providing the registration data using computer / mobile system or by purchasing product(s) from Website. The term “we”, “us” or “our” shall be referred to on the Website.

  1. Shipping Timelines

We strive to deliver your orders as swiftly as possible. Please find below the estimated shipping timelines for various locations:

  • Metro Mumbai: 12-48 hours;
  • Navi Mumbai, Thane: 12-72 hours;
  • Delhi, Bangalore, Hyderabad, Pune, Ahmedabad: 3 to 5 Working days; and
  • All other locations: 5 to 8 working days.

Please note that products shipped directly from the seller will be dispatched within 48-72 hours, as they are shipped separately and may take 2 to 7 working days to be delivered.

Please be aware that these shipping dates are subject to change based on the weather and geographical conditions of the route.

  • How does the delivery process work?

Once you order product(s), either from the Website and after our system processes your order, your products are inspected thoroughly to ensure that the quality of the product(s) is intact. After the product(s) pass through the quality check, they are packed and handed over to our trusted deliver partner to deliver the product(s) to your doorstep at the earliest possibility.

  • How are product(s) packaged?

We package the product(s) as per the category of the product, the product(s) is either packed in a corrugated box or is packed with additional filling in courier polybag. We take all the measures to ensure that product(s) are delivered to you without any damage, by any chance you receive any damaged products you may seek exchange / return of the product(s) as per the ‘Return & Refund Policy’ made available for your reference on the Platform.

  • Locations to which the product(s) are shipped.

We ship product(s) throughout India.

  • If an order has been shipped, can you track it?

After you place your order on the Platform, you can track the status of your order by clicking “My Order” on the Website.

  • Estimated shipping time.

We usually dispatch most of the orders within 01 (One) business days.

  • Multiple shipments

There is a possibility that your order may be shipped in different parts if you have ordered different products under one order.

  • Shipment charges

A flat shipment charge of INR 50/-(fifty) is applicable in respect of all prepaid orders below the net value of INR 749/-(seven hundred & forty-nine) post any discount applied and there shall be no shipment charge for order of value above INR 749/- (four hundred ninety-nine).

  1. Governing Law

The Hon’ble Courts at Bengaluru, Karnataka shall be the exclusive competent courts to deal with the issues arising out of Shipping Policy to the exclusion of all other courts in India.

  1. Arbitration

 Any dispute, differences or controversy of whatever nature and howsoever arising under or out of or in relation to this Terms of Use (including its interpretation) between the parties and so notified in writing (the ‘Dispute’) shall be referred to Arbitration Centre-Karnataka for Arbitration. Arbitration shall be conducted by a Sole Arbitrator appointed by the ‘Arbitration Centre-Karnataka’ as per Arbitration and Conciliation Act, 1996 as amended from time to time. The venue of Arbitration shall be Bangalore and it shall be conducted in English language. The arbitration award shall be final and binding on the Parties. In any case, for supervisory, injunctive relief or relief of specific performance, this Terms of Use and any Dispute shall be subject to the exclusive jurisdiction of courts in the city of Bengaluru, India.

Payment and Billing Policy:

The Payment and Billing policy governs the payment terms, billing procedures, and related matters for all transactions conducted through vitalvittles.in via our website and other digital platforms. By making a purchase, you agree to the terms set forth therein:

 

  1. Accepted payment methods:
  • 1. We accept the following modes of payment for all purchases: Credit cards (Visa, Mastercard, RuPay, American Express, etc.), debit cards (Visa, Mastercard, RuPay, etc.), Unified Payment Interface(UPI), net banking (all major Indian banks), Digital Wallets (PayTM, PhonePe, Google Pay, Amazon Pay, etc.), EMI and Buy Now Pay Later (wherever explicitly offered).
  • 2. All transactions shall be processed in Indian Rupees (INR).
  1. Payment Processing and Security:
  • 1. All online payments are processed through secure, third-party payment gateways that comply with the Payment and Settlement Systems Act, 2007 and applicable RBI guidelines.
  • 2. We do not store or have access to the full payment card details of our Users. Transactions are encrypted using industry-standard Secure Socket Layer (SSL) technology and PCI-DSS (Payment Card Industry Data Security Standard) compliance protocols.
  • 3. In case of payment failure due to banking issues, the User may attempt the payment again or contact their financial institution. The Company shall not be responsible for delays or failures caused by third-party payment processors or banks.
  1. Billing and Invoice:
  • 1. A digital invoice shall be issued for every successful purchase and sent to the registered email address of the User.
  • 2. Prices of products are [inclusive/exclusive] of GST as per applicable laws. The GST invoice shall be provided upon request

  • 3. Chargeback claims shall be handled as per the policies of the respective payment gateway and bank. We reserve the right to dispute any chargeback claims if the transaction was found to be authorized.
  1. Subscription and Auto-Renewals
  • 1. If the User subscribes to any recurring service, they consent to automatic billing for subsequent periods unless cancelled before the renewal date.
  • 2. Subscription cancellation must be at least 3 days before the renewal date to avoid automatic charges for the next billing cycle.
  • 3. The Company reserves the right to terminate subscriptions if fraudulent activity or payment failure is detected.
  1. Dispute Resolution:
  • 1. Any disputes arising out of payment transactions shall be governed by the laws of India and be subject to the exclusive jurisdiction of the courts in New Delhi, India.
